This (...) is the second half of Elders' metaphysical study as promised in the prior volume (reviewed in THE THOMIST, 50 [1986], 463· 465) on common being. The present book centers on God, in contrast to ens commune. But it strongly renews {pp. 7, 24) the insistence that no Wolffian separation of ontology from philosophical theology is Summa theologiae in showing first that God's existence is not immedi· ately evident to us but needs to be demonstrated (pp. 28-88). It then presents the " five ways " for demonstrating the divine existence, with Latin text and German translation side by side {pp. 89-137). It re· duces other suggested " ways " to some one of the five, or else sets them aside in one manner or another (pp. 137-142). After that it treats the divine attributes according to the ways of negation, causality and eminence {pp. 143-187), and then the naming of God (pp. 189· 221), God's knowledge, life, truth, power and will (pp. 223-275), and :finally the divine action upon creatures (pp. 277-315). This treatment proceeds strictly in the order followed by the Summa theologiae. The book concludes (p. 317) that the philosophical theology of Aquinas is a coherent whole, based upon everyday experience yet for that very reason on principles that are metaphysically evident and ad· mitted by "common sense" (see also pp. 15, 200). The treatment is neatly addressed to the problems that have been under lively discussion during the past few decades, such as the " death of God." These are dealt with against an extensive and admirably detailed historical background stretching from the Greeks to the present day, with wide coverage of secondary literature, thoroughly justifying the book's designation of itself as a study pursued "in historical perspective." However, the advisability of the Summa's order of treatment for a work meant to explain the metaphysical thinking of Aquinas is open to question. Elders (p. 8, n. 3; p. 13, n. 4) is acquainted with the vigor· 338 BOOK REVIEWS ous protests of Gilson and Pegis against reading as philosophy what Aquinas wrote as theology. Yet Elders (p. 8) allows the stand that on the ground of its intrinsic rationality Aquinas would have adhered to the Summa's order even if he had been writing a purely philosophical theology. In the present case, one may strongly object, the result is a way of thinking that dulls sensitivity to the core position of existence in Aquinas' metaphysical thought. The long and checkered history of the notion " common sense " in western philosophy should be enough to dissociate that concept from Thomistic metaphysics, and here the appeal to " everyday experience " as a support calls first for careful analysis of the radically different ways in which existence and nature are originally attained by human cognition. The book finds (p. 101, n. 61), for instance, that in the demonstration of God's existence from motion Aquinas is employing without radical distinction the same principles as Aristotle but is applying them more strictly. The pro· foundly distinctive character of Aquinas' metaphysical acumen is thereby missed. This may be aptly illustrated by one example. The pointed assertion of the Summa contra gentiles (1.9.Inter) that without consideration of the proof for God's existence " omnis consideratio de rebus divinis necessario tollitur," is understood by Elders to mean "... ist jede philosophische Betrachtung des Seienden letztlich grundlos" (p. 89). Yet granting without hesitation that the proof of the divine existence is necessary for understanding metaphysically " that which exists " (das Seiende), one may, against Elders, take the statement of Aquinas at its face value as much more finely pointed. It means what it literally says, namely that things divine cannot be understood apart from consideration of the proof for God's... (shrink)

Kockelmans provides a clear and systematic treatment of the central themes and topics of Heidegger's later writings, focusing on the all-important question of the relationship of truth and Being. If we are to understand Heidegger's thought, Kockelmans explains, we must conceive it as a path or way, rather than as a finished system. Adopting this approach himself, Kockelmans leads us with scholarly care through the wide range of issues that Heidegger wrote about between roughly 1935 and 1965. (...) After a discussion of Heidegger's own effort to learn to think, subsequent chapters present Heidegger's views on such matters as the meaning of Being; the ontological difference; heaven and earth; gods and mortals; and language, art, science, technology, ethics, and politics. Although clinical ethics consultation is a high-stakes endeavor with an increasing prominence in health care systems, progress in developing standards for quality is challenging. In this article, we describe the results of a pilot project utilizing portfolios as an evaluation tool. We found that this approach is feasible and resulted in a reasonably wide distribution of scores among the 23 submitted portfolios that we evaluated. We discuss limitations and implications of these results, and suggest that this is a significant step (...) on the pathway to an eventual certification process for clinical ethics consultants. As scholars envision a new regulatory or statutory neurorights schema it is important to imagine unintended consequences if reforms are implemented before their implications are fully understood. This paper critically evaluates provisions proposed for a new Chilean Constitution and evaluates this movement against efforts to improve the diagnosis of, and treatment for, individuals with disorders of consciousness within the broader context of disability law, international human rights, and a capabilities approach to health justice as advanced by Amartya Sen and Martha (...) Nussbaum. Framed in this way, any neurorights regime would need to satisfy several criteria. First it would be obliged to balance both positive and negative rights in the furtherance of human capabilities. Second, it would need to be future oriented and informed about the science it sought to regulate and not fall prey to science fiction fantasies that remain ungrounded in reality. Third, it would need to be specific and avoid generalizations that would lead to conceptual confusion and litigation that could delay scientific progress. Finally, it would need to harmonize novel neurorights with long-established norms in international disability and human rights law. A failure to meet these criteria will destine any novel neurorights regime to the periphery. At this juncture Chile’s nascent constitutional venture into neurorights fails to satisfy these criteria. While there yet may be a role for a more capacious and bivalent articulation of neurorights that account for capabilities and precedent, the current Chilean neurorights reforms are vague and premature. As such they should undergo additional scholarly scrutiny and should not be adopted by other jurisdictions. (shrink)

This essay critiques the fiercely utilitarian allocation scheme of Cameron et al. Children have no hope of recovery if their lives are cut short based on administrative protocols that misrepresent the nature of their conditions. Unilateral futility judgements - especially those based on a false predicate - are discriminatory. When considering the best interests of children, we should see possibility in disability and not advance ill-informed utilitarianism.

In this essay, the author reflects on his development as a physician by recounting two patient narratives of patients he cared for as a third year medical student. In the process of telling these stories of sickness, the author also provides a window on medical practice in the 1980’s in an academic medicine center and how practices have changed. Decades before what has been dubbed “narrative medicine,” the author learned the power of words to shape relationships and promote professional formation.

This book offers comparative ontologies of both Islam and liberalism as discourses more broadly construed. The author argues that, despite recent efforts to speak of overlapping consensuses and discursive congruence, the fundamental categories that constitute 'Islam' and 'Liberalism' remain very different, and that these differences should be taken seriously. Thus far, no recent scholarly works have explicitly or meticulously broken down where these differences lie. The author rigorously explores questions related to rights, moral epistemologies, the role of religion in the (...) public sphere, and more general approaches to legal discourse, via primary and canonical sources constitutive of both Islam and liberalism. He then goes on to articulate why communitarian modes of thought are better suited for engaging with Islam and contemporary socio-political modes of organization than liberalism. Patient narratives from two investigational deep brain stimulation trials for traumatic brain injury and obsessive‐compulsive disorder reveal that injury and illness rob individuals of personal identity and that neuromodulation can restore it. The early success of these interventions makes a compelling case for continued post‐trial access to these technologies. Given the centrality of personal identity to respect for persons, a failure to provide continued access can be understood to represent a metaphorical identity theft. Such a loss recapitulates the pain of (...) an individual's initial injury or illness and becomes especially tragic because it could be prevented by robust policy. A failure to fulfill this normative obligation constitutes a breach of disability law, which would view post‐trial access as a means to achieve social reintegration through this neurotechnological accommodation. Jacques Rancière: An Introduction offers the first comprehensive introduction to the thought of one of today's most important and influential theorists. Joseph Tanke situates Rancière's distinctive approach against the backdrop of Continental philosophy and extends his insights into current discussions of art and politics. Tanke explains how Rancière's ideas allow us to understand art as having a deeper social role than is customarily assigned to it, as well as how political opposition can be revitalized. The book presents Rancière's body (...) of work as a coherent whole, tracing key notions such as the distribution of the sensible, the aesthetics of politics, and the supposition of equality from his earliest writings through to his most recent interventions. Tanke concludes with a series of critical questions for Rancière's work, indicating how contemporary thought might proceed after its encounter with him. The book provides readers new to Rancière with a clear overview of his enormous intellectual output. Emotion regulation is one of the major foci of study in the fields of emotion and emotional development. This article proposes that to properly study emotion regulation, one must consider not only an intrapersonal view of emotion, but a relational one as well. Defining properties of intrapersonal and relational approaches are spelled out, and implications drawn for how emotion regulation is conceptualized, how studies are designed, how findings are interpreted, and how generalizations are drawn. Most research to date has been (...) conducted from an intrapersonal perspective, and the shortcomings of this approach for understanding emotion regulation are highlighted. The article emphasizes major conceptual and methodological steps required for a fuller description of the process of emotion regulation. (shrink)
